Appellant John L. Parker appeals after the trial court granted summary judgment in favor of appellee 20801, Inc. ("20801"). In two points of error, appellant contends that the trial courts grant of summary judgment was improper because (1) Section 2.03 of the Texas Alcoholic Beverage Code does not preempt the common law causes of action asserted by appellant; and (2) appellee failed to establish the safe harbor affirmative defense contained in Section 106.14(a)(3) of the Texas Alcoholic Beverage Code. We affirm in part and reverse and remand in part.
